Welcome to Elevate Talent Partners. By engaging with our services, you agree to the following terms and conditions. Please read them carefully before using our services. If you do not agree to these terms, you should not use or engage with our services.
1. Services Provided
Elevate Talent Partners offers recruiting and staffing services, including but not limited to:
Sourcing, screening, and presenting qualified candidates to clients.
Providing advisory services on hiring practices.
Facilitating hiring processes between candidates and clients.
Resume writing
LinkedIn Profile enhancement
2. Client Obligations
To ensure the success of our recruiting services, the client agrees to:
Provide detailed job descriptions, hiring criteria, and company expectations.
Maintain open communication throughout the recruitment process.
Notify us within 48 hours of any candidate offer acceptance.
Comply with all employment and labor laws applicable in the candidate’s location and the client’s jurisdiction.
3. Fees & Payment Terms
Contingency Search: 18% of the candidate’s first-year base salary, payable within 45 days of the candidate’s start date.
Invoices not paid within the due date are subject to a interest of 2% per month.
The client agrees to notify Elevate Talent Partners if the role or compensation changes after the hiring offer is accepted.
4. Guarantee & Replacement Policy
If a placed candidate voluntarily resigns or is terminated within 30 days of their start date, Elevate Talent Partners will provide a replacement candidate at no additional cost.
This guarantee is void if:
The client fails to notify us of the termination within 30 days.
The position’s requirements or compensation have changed without prior communication.
Payment terms have not been met by the client.
5. Candidate Ownership
Candidates introduced by Elevate Talent Partners will be considered “owned” by our agency for 12 months from the date of introduction.
If the client hires a candidate for any role within this time, the full placement fee will apply.
6. Confidentiality
Both parties agree to keep confidential any proprietary, financial, or personal information shared during the recruiting process. The client agrees not to contact or hire any candidate through other means once introduced by Elevate Talent Partners without written consent.
7. Limitation of Liability
Elevate Talent Partners will use reasonable efforts to present qualified candidates. However, we are not responsible for any candidate’s performance or employment-related decisions. The agency's liability is limited to the replacement policy outlined above.
8. Termination of Agreement
Either party may terminate this agreement with 30 days' notice. Termination will not affect payment obligations for candidates placed before the termination date.
9. Governing Law
This agreement will be governed by and construed in accordance with the laws of Texas, United States. Any disputes will be resolved in the courts of Texas, United States.
10. Force Majeure
Elevate Talent Partners will not be liable for any delay or failure to perform due to events beyond our reasonable control, including natural disasters, labor disputes, or government actions.
11. Entire Agreement
This agreement constitutes the entire understanding between the client and Elevate Talent Partners, superseding all prior agreements or understandings, written or oral, related to the subject matter.
